How long does it take to get a bail hearing?

 

 

After you are arrested, you will have to wait before going to court.

Every individual arrested reserves the right to be brought before the court within 24 hours or within a reasonable time. Bail court is open 365 days a year. On weekends and on holidays this is called Weekend and Statutory Holiday (WASH Court).

Can a defendant request a hearing?

Is it possible to get out before seeing a Justice of the Peace or Judge?

Release can occur at the police station by way of a Form-9 or Form-10 and 11.1. In the event an individual is not released from the police station, they will be brought before bail court. In this case they cannot be released without appearing before a Justice of the Peace or Judge for a bail hearing.


How long does a bail hearing take to commence?

Private counsel often have priority in bail courts, therefore a private lawyer can have an individual’s bail hearing commenced almost immediately.


How long does it take to be released after a bail hearing?

Once a release order is made by the Justice of the Peace or Judge, the individual ought to be released immediately.
